2. DEFINITIONS
In these Terms & Conditions, the following terms shall have the following meanings:
• We / Us / Our — Plant Pot Shop, the seller and operator of this website
• You / Customer — the individual placing an order or using this website
• Goods / Products — any plant pots, planters, or accessories listed for sale on our website
• Order — a request to purchase Goods submitted through our website
• Contract — the legally binding agreement formed upon our acceptance of your Order

• Carrier — any third-party courier or postal service used to deliver your Order
• Delivery Area — the United Kingdom, and internationally where we offer shipping
3. USE OF OUR WEBSITE
By accessing and using this website, you agree to comply with these Terms & Conditions. Our website and its content are for personal, non-commercial use only. You must not misuse, copy, reproduce, or redistribute any content from this website without our prior written consent.
We reserve the right to restrict access to parts of our website at any time and without notice. We are not responsible for any loss or damage resulting from your inability to access the site.
4. PLACING AN ORDER
When you place an order on our website, you are making an offer to purchase goods. Your order is not confirmed until we accept it. We will acknowledge receipt of your order by email; however, this acknowledgement does not constitute acceptance.
A binding contract between you and Plant Pot Shop is formed when we:
• Allocate and reserve the goods specifically for your order
• Dispatch the goods to you
• Issue a formal order confirmation email
We reserve the right to decline any order at our discretion — for example, due to stock availability, payment issues, delivery restrictions, or suspected misuse. If we decline your order, any payment made will be refunded in full within 14 days.
You are responsible for ensuring that all order details — including delivery address, product selection, and contact information — are accurate at the time of placing your order.
5. GOODS, DESCRIPTIONS & AVAILABILITY
We make every effort to represent our products accurately. However, all product photographs and descriptions are provided as a guide only. Colours may vary slightly depending on your screen settings.
Many of our pots are handcrafted or produced through individual manufacturing processes. Slight variations in colour, glaze, shape, and size are a natural part of the production process and give each piece its unique character. These are not considered faults.
Unless stated otherwise, plant pots are not 100% waterproof. We recommend using a suitable liner to protect surfaces and prevent water damage.
We cannot guarantee that all products will always be available. Stock levels may change without notice. If an item becomes unavailable after your order is placed, we will contact you to offer an alternative or a full refund.
6. PRICING & PAYMENT
All prices are displayed in Pounds Sterling (GBP) and include VAT where applicable. Prices are correct at the time of display but are subject to change. Delivery charges, if any, will be shown at checkout.
If a product has been incorrectly priced due to an error, we are not obligated to fulfil the order at that price. We will notify you before dispatch and give you the option to proceed at the correct price or cancel for a full refund.
Payment is taken at the time of ordering. We accept major debit and credit cards processed through secure, encrypted payment gateways. We do not store your full card details.
If payment cannot be successfully processed, we reserve the right to cancel the order. Title to goods remains with Plant Pot Shop until full payment has been received and confirmed.
7. DELIVERY
We currently deliver across the United Kingdom. International shipping may be available to selected destinations — please refer to our Shipping Policy for full details.
Estimated delivery times are provided as a guide and are not guaranteed. Occasional delays may occur due to factors outside our control, including courier delays, adverse weather, or peak demand periods.
It is your responsibility to ensure the delivery address provided is accurate and complete. Plant Pot Shop cannot be held liable for delays, lost parcels, or additional charges resulting from incorrect address details.
If a delivery attempt is unsuccessful due to your unavailability, the carrier may attempt redelivery or return the parcel to us. Additional charges may apply for re-dispatch.

8. CANCELLATIONS, RETURNS & REFUNDS
8.1 Cancellation Before Dispatch
You may cancel your order at any time before it is dispatched by contacting us at support@plant-pot.co.uk. A full refund will be issued within 14 days of cancellation.
8.2 Returns — Change of Mind
If you change your mind, you may return your order within 30 days of delivery, provided the goods are:
• Unused and in their original condition
• In original packaging (or securely repackaged)
• Not damaged due to improper handling
Return postage costs are the responsibility of the customer unless the item is faulty. Once received and inspected, we will issue a full refund of the product cost within 14 days. Original delivery charges are non-refundable for change-of-mind returns.
8.3 Damaged or Faulty Items
If your item arrives damaged or faulty, please contact us within 48 hours of delivery. To help us resolve your issue quickly, please provide:
• Your order number
• A clear description of the fault or damage
• Photographs of the item and its packaging
Where a valid claim is accepted, we will at our discretion offer one of the following:
• A free replacement (subject to availability)
• A full or partial refund
• A store credit or discount voucher
Please note: minor variations in handcrafted ceramics — including differences in glaze, colour, or texture — are expected and not considered faults.
8.4 Non-Returnable Items
The following items cannot be returned unless they arrive damaged or faulty:
• Bespoke or made-to-order products
• Items that have been personalised or customised
• Items returned without prior agreement from us
9. INTELLECTUAL PROPERTY
All content on this website — including text, images, logos, and design — is the property of Plant Pot Shop or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from this site without our express written permission.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Plant Pot Shop shall not be liable for any indirect, incidental, or consequential losses arising from your use of our website or the purchase of goods, including but not limited to loss of revenue, data, or business opportunity.
Our total liability to you in connection with any order shall not exceed the total amount paid by you for that order.
Nothing in these Terms & Conditions limits our liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation.
11. PRIVACY & DATA
Your personal data is collected and used in accordance with our Privacy Policy. By using this website, you consent to the processing of your data as described therein. We will not sell or share your personal data with third parties except as required to fulfil your order.
12. GOVERNING LAW
These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. CHANGES TO THESE TERMS
We reserve the right to update these Terms & Conditions at any time. Changes will be published on this page with a revised effective date. Your continued use of our website or submission of an order after any changes constitutes acceptance of the updated terms.

INTERNAL NOTES
For your reference — areas to review and update over time
The following points highlight key decisions made during drafting, and items you should revisit as your business grows:
• Business Registration Number — Not included yet. Once registered, add your Companies House number to Section 1 (About Us).
• VAT Number — Not included. Add your VAT registration number to Section 6 (Pricing & Payment) once registered.
• Returns Window — Set to 30 days (Section 8.2). This is customer-friendly and above the statutory 14-day minimum. Update if you wish to tighten or extend this.
• Damage Claim Window — Set to 48 hours (Section 8.3) to match the Shipping Policy. Consider extending to 72 hours if your courier is slower.
• Shipping Policy Link — Section 7 references plantpot-shop.co.uk/shipping-policy — confirm this URL is live on your site.
• Privacy Policy — Section 11 references a Privacy Policy. Ensure you have a separate Privacy Policy page live on your site (required by UK GDPR).
• International Shipping — Section 7 mentions international shipping is available 'to selected destinations'. Update or remove once you confirm exact countries.
• Made-to-Order / Bespoke Items — Section 8.4 excludes these from returns. If you do not currently sell bespoke items, this section can be removed.
• Governing Law — Set to England and Wales (Section 12). If your business base changes, update accordingly.
• Effective Date & Last Updated — Both currently set to January 2025. Always update the 'Last Updated' date whenever any changes are made.
• Payment Methods — Section 6 references debit/credit cards via secure gateways — update if you add Buy Now Pay Later (e.g. Klarna) or other methods.
• Trade / Wholesale Orders — No trade terms are included. If you start supplying businesses (interior designers, offices etc.), you may need a separate Trade T&C document.
• Legal Review — These terms are drafted for general UK e-commerce and informed by industry practice. We recommend having a UK solicitor review them before publishing, especially once your turnover grows.
